1. Introduction
Welcome to EliteStaff. These Terms and Conditions ("Terms") govern your access to and use of the EliteStaff platform, including our website, mobile application, and related services (collectively, the "Platform").
By accessing or using the Platform as a Host (client) or an Agent (staff), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform.
EliteStaff acts as a marketplace connecting enterprise hosts with professional brand ambassadors and event staff. We are not an employer but a facilitator of professional services.
2. Platform Conduct
To maintain the premium nature of the EliteStaff ecosystem, all users must adhere to the following standards of conduct:
- Accuracy: All profiles, experience records, and event requirements must be truthful and accurately represented.
- Professionalism: Users must communicate professionally and respect the scheduled timing of all booked engagements.
- Exclusivity: Users agree not to circumvent the Platform to arrange engagements directly outside of EliteStaff to avoid service fees.
3. Payment Terms
EliteStaff ensures a secure and transparent payment environment for both hosts and agents.
For Hosts
Payments for staffing services are collected upon booking confirmation. Funds are held in escrow and released to agents upon verified completion of the event.
For Agents
Agents receive payment within 72 hours of event completion, provided no disputes are filed. EliteStaff deducts a transparent service fee for platform maintenance.
Disputes regarding payments must be raised within 24 hours of the scheduled event completion time.
4. Intellectual Property
The Platform, including its software, designs, algorithms, and branding, is the exclusive property of EliteStaff and is protected by copyright, trademark, and other laws.
Users are granted a limited, non-exclusive, non-transferable license to access the platform solely for the purpose of booking or providing staffing services. You may not reverse engineer, copy, or redistribute any part of our platform without explicit written consent.
5. Termination
We reserve the right to suspend or terminate any user account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform or us.
Upon termination, your right to use the Platform will cease immediately. Any outstanding payments owed to EliteStaff or other users remain due and payable according to the terms existing at the time of termination.
6. Limitation of Liability
EliteStaff is provided "as is" and "as available." To the maximum extent permitted by law, EliteStaff shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the platform.
Our total liability for any claim arising out of these Terms shall not exceed the total amount of fees paid to EliteStaff by you during the three months preceding the claim.
